Terms and Conditions

The above-named and undersigned recreation permit applicant (Permittee) does hereby grant consent for Green Diamond to conduct a criminal background check on Permittee. Permittee understands and agrees that Green Diamond may grant or deny this permit application in its sole discretion. Permittee hereby agrees that Permittee and Permittee’s spouse and dependents shall comply with the following terms and conditions for use of the property of Green Diamond Resource Company (Green Diamond) if this Permit is approved by Green Diamond:

  1. COMPLIANCE WITH LAW. Permittee agrees to comply with all laws and regulations of the United States and the State of Washington that apply to Permittee’s use of Green Diamond property. Permittee may hunt and fish on Green Diamond property provided that Permittee complies with Washington laws an d regulations for hunting and fishing and any federal laws regulating protection and use of fish and wildlife. ANY VIOLATION OF STATE OR FEDERAL LAW BY A PERMITTEE ON GREEN DIAMOND PROPERTY WILL INVALIDATE THIS PERMIT AND MAY BE REFERRED TO STATE OR FEDERAL OFFICIALS FOR CIVIL OR CRIMINAL ENFORCEMENT.
  2. GREEN DIAMOND RULES. Permittee acknowledges that Permittee has been provided with a copy and an opportunity to review the Green Diamond Rules for Recreation. Permittee agrees to comply with the Green Diamond Rules for Recreation. Permittee agrees that the terms of the Permit and the Green Diamond Rules for Recreation apply to the undersigned Permittee and Permittee’s spouse and dependents who use Green Diamond property pursuant to this Permit. Green Diamond reserves the right to modify the Green Diamond Rules for Recreation with notice to Permittee at any time and Permittee agrees that such modifications shall be binding on Permittee.
  3. WARNING OF HAZARDS AND ASSUMPTION OF RISK. Permittee acknowledges that Green Diamond property is used for commercial timber operations, and that certain dangers and natural or man-made hazards may occur or be present on the Green Diamond property. These dangers and hazards include, but are not limited to: primitive roads, log ging operations, use of roads by heavy trucks for hauling of logs, rock and equipment, controlled burning, herbicide applications, hunting, falling trees, the possibility of accident or illness in remote places without medical facilities, difficult and steep terrain, the forces of nature, and the presence of wildlife. Permittee voluntarily assumes all risks to Permittee and Permittee’s spouse and dependents associated with all such dangers and hazards on Green Diamond property that could result in property damage and/or injury or death.
  4. RELEASE OF CLAIMS AND INDEMNITY. Permittee agrees to release Green Diamond, and its directors, officers, employees, and agents from responsibility or liability for any costs, claims or expense incurred or suffered by reason of damage to property or injury or death arising out of or in any way connected with actions or omissions of the undersigned Permittee and Permittee’s spouse and dependents who use Green Diamond property pursuant to this Permit. Permittee hereby agrees to indemnify, defend and hold Green Diamond harmless from any such claims as well as the claims of other parties that arise out of the use of Green Diamond property by Permittee and Permittee’s spouse and dependents. This release and indemnity shall operate as a release and indemnity by Permittee’s heirs, personal representatives and next of kin.
